    Son and DUI

    HI my son has just been given a DUI whilst on leave and has to go to court, if he looses his licence will he get thrown out hes training as a para in Colchester. can anyone help heartbroken Mum. Thanks

    I've known people who've had a ban, but they were already serving, not training. He'd best talk to his CoC to find out. It might not be good news though, there are plenty of people coming up behind him who'd want his place.

    Hi and many thanks for the reply, actually he is serving in the artillery but wants to do para, he passed out 12 months ago do you think will make a difference?

    I can only offer the same advice as Bodger I am afraid. My husband was stupid enough to get a DUI several years ago (he got in the car 24 hours after going out on the drink) and was given a big slap on the wrist, but in training it may well be a harsher penalty.

    Hi was your husband banned? My son is now at his regiment hes doing further specialist training(sorry about the confusion).

    My husband was banned for 12 mths reduced to 9 mths because he completed one of those training courses. If he is at Regt they may well just give him a severe kick up the arris and he will most certainly receive a letter telling him what a disappointment he is right now. It will also be noted on his regimental sheet and if he is fined it will affect his future prospects if it happens again (Not talking promotion - although it might stall that because they do look at conduct).

    He may well either get a major slap on the hand by his CO or he could possibly gain a warning, could go either way and depends on whether or not the Army feels he has been brought into disrespute. He has to tell the reggies, they'll run through what wll be done.

    Just spoke to hubby he reckons that he won't be kicked out as long as he didn't injure anyone or damage property. If that is the the case he said the worst that would happen would be that he is put on a 3 month warning and a reggie entry. However he does need to tell someone or it will be looked upon extremely dimly.

    A lot will also depend on if he has to drive to do his job, cause if he can't drive he can't do his job etc. best thing to do is get him to speak to his CoC ASAP as has been said previously. His previous record is also likely to play a part ie good boy he will probably end with a major sanction which will result in a promotion ban for a few years, bad boy always in trouble no reason to keep him.

    Hi thanks for all your replies. Does anyone know of new rulings within the force as his CO has said there are. My son has not read or heard of these, apparantly saying drink drivers are thrown out. His Sargeant is giving hima real hard time is being very sarcastic and has shown him up in front of the other lads. He was very distraught at one point says he is being tortured I must admit I told him to leave as I cannot bare the thoughts of him suffering like this, he knows he has done wrong and is totally discusted with himself ,surely they cannot treat a human being like this Army or no army. We have now employed a solicitor inthe field costing a fortune. He knows of lads kept in but this new ruling thing is obviously very confusing.Does anyone have any concrete evidence of lads being kept in because if he is dismissed we are going to take the Army to court, for unfair dismissal. Does this sound feasable?

    Hi he has an excellent record and apprasal, he doesnt drive he in a gunner and wnats to upgrade to 7 para? He has spoken to his Co and he has been told there are new rules. My son feels realy CRAP and we are so worried about him. Any ideas will help. Thanks

    I hope that he does manage to stay in, but (although this isn't based on any facts), I'd say that if he does get kicked out, your chances of suing them for unfair dismissal are slim to none.

    Try to see it from his Sgt's and CoC point of view, why should they go easy on him?

    The reality is that he may off done this before and been lucky enough not to have been caught, so if a bit of harsh treatment stops him risking his life and those of other people, then it will be worth it in the long run.

    Sorry to rant, bit of a sore subject with me this one ......DUI kills ....

    Spoke to Mr Joey who has experience in this area. It's on a knife edge as to whether he's in or out. Trouble is, with the SDSR they are looking to cut personnel. If it comes down to choosing between someone with a totally unblemished record and this guy, who would you choose for the chop?
